Terms and Conditions

These Terms govern the use of Kouzee, including rules of use, limitations of liability and conditions applicable to AI-generated content and to the catalog of brand products.

Identification and acceptance

This is a courtesy translation. The Spanish version of these Terms is the legally binding one; in case of any discrepancy, the Spanish version prevails.

This site and platform are operated by De Diseño SpA, RUT 78.127.669-3, with domicile at Santa Filomena 85, Recoleta, Región Metropolitana, Chile. By registering or using the platform, you accept these Terms and the Privacy Policy in force.

  • These Terms apply to all users, including free and paid accounts.
  • If you do not agree with these Terms, you must not use the platform.

Use of the platform and prohibited conduct

  • You must use the platform in accordance with Chilean law and applicable intellectual property regulations.
  • It is prohibited to introduce malware, breach security, use the platform for fraud or impersonation, or infringe third-party rights.
  • We may suspend or terminate accounts for serious breach, abusive use, or risks to the security of the platform and of other users.

Nature of AI-generated results

The images and results generated with AI in Kouzee are for reference only, for inspiration and creative exploration. They do not constitute an exact simulation of reality.

  • Results may contain errors of proportion, scale, color, materiality, perspective, or context.
  • A product may appear larger or smaller than its actual size in a generated image.
  • The user is responsible for validating measurements, specifications, availability, and commercial conditions through the official channels of each brand before purchasing, recommending, or carrying out a project.

Product catalog and relationship with brands

Kouzee operates as a visualization and inspiration platform featuring catalog products from different brands. Brands are responsible for their own commercial offering.

  • De Diseño SpA is not a direct seller of the catalog products, unless expressly stated in a specific flow.
  • We are not liable for the quality, safety, stock, shipping, delivery times, after-sales service, warranties, exchanges, or returns of products offered by brands.
  • Decisions to purchase, contract, or specify based on generated images are the exclusive responsibility of the user and of the commercial relationship with the corresponding brand.

Plans, payments, and subscriptions

  • The plans, prices, and conditions in force are stated in the Kouzee App.
  • Prices are expressed and charged in United States dollars (USD), with applicable taxes included.
  • A corresponding tax document is issued for each charge.
  • Payments are processed through payment method providers and are subject to their terms and conditions.
  • Paid subscriptions renew automatically unless previously cancelled by the user.
  • We may modify prices or plan conditions by giving prior notice through the official channels of the platform.

Intellectual property and licenses of use

  • The software, design, brand, interfaces, and Kouzee's own content are owned by De Diseño SpA or its licensors.
  • The user retains rights over their content, granting De Diseño SpA a non-exclusive and limited license to operate, secure, audit, and improve the service.
  • What you represent about the content you upload or generate is set out in the section “What you represent when uploading or generating content”.

Your content: what you upload and what you generate

You are solely responsible for the content you upload to Kouzee —images, videos, audio, text and prompts— and for the content you generate with the platform's AI tools, as well as for how you use it inside and outside Kouzee.

  • Kouzee does not review in advance all the content you upload or generate; the fact that Kouzee allows it does not mean that its use is lawful.
  • If you publish, share or commercially use content generated in Kouzee, you are responsible for complying with the law and third-party rights in that use.

What you represent when uploading or generating content

Every time you upload or generate content in Kouzee, you represent and warrant that:

  • You hold the rights, licenses or authorizations needed for what you upload, including the right to use it as a reference in an AI generation.
  • You do not use the likeness, voice or identity of real people without their express written consent. Nor do you use the likeness, voice or identity of public figures or minors.
  • You do not infringe copyrights, trademarks, image rights, privacy or other third-party rights.
  • You do not create content that passes off something generated with AI as real in order to impersonate, defame, defraud or mislead (so-called deepfakes).

Virtual characters and avatars

Some Kouzee tools let you use virtual characters —fictional avatars with a realistic appearance— as a reference to generate images or videos. If you upload or use a virtual character, you represent that:

  • It is an original, fictional creation, made by you or commissioned by you from a third party holding the necessary rights.
  • It is not identical or similar to any real person, and it was not created from photos, videos or the voice of a real person.
  • You keep evidence of its creation —source files, generation records or other records— and will provide it to Kouzee upon request.

If you cannot prove the origin of a virtual character when asked, Kouzee may block its use and the content generated with it.

AI providers' policies

Kouzee generates content with third-party models, including Google, OpenAI, Black Forest Labs, BytePlus (ByteDance) and Topaz Labs. By using these tools you also agree to comply with their usage policies, which may prohibit content beyond what these Terms state.

  • If a provider considers that content breaches its policies, Kouzee may block or remove it even if it does not expressly breach these Terms.

Generation records

Kouzee records every AI generation: the account that made it, the date, the prompt, the input files and the result. We do this for security, to prevent abuse and to comply with legal obligations and those imposed on us by AI providers.

  • We may provide these records to AI providers or to authorities when required by law or to address a legitimate claim about that content.
  • What data is kept, why and for how long is explained in the Privacy Policy.

Moderation, content removal and reports

  • Kouzee may review, block or remove content, and suspend or close accounts, when there are reasonable indications that they breach these Terms or the law, or when an AI provider or an authority requests it.
  • If you believe that content in Kouzee uses your likeness, voice or identity without permission, infringes your rights or is misleading, write to us at hola@kouzee.com stating the content, the reason and how to contact you.
  • We review every report and, where appropriate, remove the content, take action on the account and let you know what we did.

Limitation of liability

  • The service is provided on an as-is and as-available basis, without any warranty of uninterrupted continuity or of the total absence of errors.
  • We do not guarantee specific results derived from the use of AI models, nor the permanent availability of external technology providers.
  • To the maximum extent permitted by law, the total liability of De Diseño SpA is limited to the amounts actually paid by the user in the three months prior to the event giving rise to the claim, except in cases of willful misconduct or gross negligence.

Indemnity, suspension, and termination

  • You agree to hold harmless and indemnify De Diseño SpA, its partners and the AI providers used by Kouzee against any claim, damage, fine or expense —including attorneys' fees and court costs— arising from the content you uploaded or generated, from its use, from a breach of the representations in these Terms or from your unlawful use of the platform.
  • We may temporarily suspend or terminate access if we detect material breaches or operational and security risks.
  • The user may close their account or cancel their subscription through the mechanisms available on the platform.

Modifications, governing law, and contact

  • We may update these Terms. The version in force will be published on this page with its update date.
  • These Terms are governed by Chilean law, and disputes are submitted to the competent courts of Santiago, Chile.
