Terms and Conditions

These Terms govern the use of Kouzee, including rules of use, limitations of liability and conditions applicable to AI-generated content and to the catalog of brand products.

Identification and acceptance

This is a courtesy translation. The Spanish version of these Terms is the legally binding one; in case of any discrepancy, the Spanish version prevails.

This site and platform are operated by De Diseño SpA, RUT 78.127.669-3, with domicile at Santa Filomena 85, Recoleta, Región Metropolitana, Chile. By registering or using the platform, you accept these Terms and the Privacy Policy in force.

  • These Terms apply to all users, including free and paid accounts.
  • If you do not agree with these Terms, you must not use the platform.

Use of the platform and prohibited conduct

  • You must use the platform in accordance with Chilean law and applicable intellectual property regulations.
  • It is prohibited to introduce malware, breach security, use the platform for fraud or impersonation, or infringe third-party rights.
  • We may suspend or terminate accounts for serious breach, abusive use, or risks to the security of the platform and of other users.

Nature of AI-generated results

The images and results generated with AI in Kouzee are for reference only, for inspiration and creative exploration. They do not constitute an exact simulation of reality.

  • Results may contain errors of proportion, scale, color, materiality, perspective, or context.
  • A product may appear larger or smaller than its actual size in a generated image.
  • The user is responsible for validating measurements, specifications, availability, and commercial conditions through the official channels of each brand before purchasing, recommending, or carrying out a project.

Product catalog and relationship with brands

Kouzee operates as a visualization and inspiration platform featuring catalog products from different brands. Brands are responsible for their own commercial offering.

  • De Diseño SpA is not a direct seller of the catalog products, unless expressly stated in a specific flow.
  • We are not liable for the quality, safety, stock, shipping, delivery times, after-sales service, warranties, exchanges, or returns of products offered by brands.
  • Decisions to purchase, contract, or specify based on generated images are the exclusive responsibility of the user and of the commercial relationship with the corresponding brand.

Plans, payments, and subscriptions

  • The plans, prices, and conditions in force are stated in the Kouzee App.
  • Prices are expressed and charged in United States dollars (USD), with applicable taxes included.
  • A corresponding tax document is issued for each charge.
  • Payments are processed through payment method providers and are subject to their terms and conditions.
  • Paid subscriptions renew automatically unless previously cancelled by the user.
  • We may modify prices or plan conditions by giving prior notice through the official channels of the platform.

Intellectual property and licenses of use

  • The software, design, brand, interfaces, and Kouzee's own content are owned by De Diseño SpA or its licensors.
  • The user retains rights over their content, granting De Diseño SpA a non-exclusive and limited license to operate, secure, audit, and improve the service.
  • The user declares that they hold the rights and authorizations over the content they upload or process on the platform.

Limitation of liability

  • The service is provided on an as-is and as-available basis, without any warranty of uninterrupted continuity or of the total absence of errors.
  • We do not guarantee specific results derived from the use of AI models, nor the permanent availability of external technology providers.
  • To the maximum extent permitted by law, the total liability of De Diseño SpA is limited to the amounts actually paid by the user in the three months prior to the event giving rise to the claim, except in cases of willful misconduct or gross negligence.

Indemnity, suspension, and termination

  • The user shall indemnify De Diseño SpA against third-party claims arising from their unlawful use of the platform or from a breach of these Terms.
  • We may temporarily suspend or terminate access if we detect material breaches or operational and security risks.
  • The user may close their account or cancel their subscription through the mechanisms available on the platform.

Modifications, governing law, and contact

  • We may update these Terms. The version in force will be published on this page with its update date.
  • These Terms are governed by Chilean law, and disputes are submitted to the competent courts of Santiago, Chile.
